By accessing and using the 3buddy website and services (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

Binding Agreement: These Terms constitute a legally binding agreement between you and 3buddy AB ("3buddy", "we", "us", or "our"). By using the Service, you represent that you have the legal capacity to enter into this agreement.

Additional Guidelines: When using specific features of the Service, you shall be subject to any posted guidelines, rules, or terms applicable to such features, which may be updated from time to time.

3buddy provides an AI-powered voice receptionist service that automates call handling, booking, customer inquiries, and related communication services for businesses.

Service Features: • AI-powered call routing and handling • Automated appointment scheduling • Customer inquiry management • Call recording and transcription (where applicable and with consent) • Integration with business systems • Analytics and reporting tools

Service Modifications: We reserve the right to modify, suspend, discontinue, or restrict access to the Service, or any part thereof, at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

To access certain features of the Service, you must register for an account and provide accurate, current, and complete information.

Account Requirements: • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account • You agree to provide accurate, current, and complete information during registration • You must update your account information to keep it accurate, current, and complete • You are responsible for maintaining the confidentiality of your account credentials

Account Security: You are responsible for all activities that occur under your account, including unauthorized access. You must immediately notify us of any unauthorized use of your account or any other breach of security.

Account Termination: We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason we deem necessary.

The Service is offered on a subscription basis with various pricing plans.

Subscription Plans: • Subscription fees are billed in advance on a monthly or annual basis • All fees are non-refundable except as required by law or as otherwise stated in these Terms • We reserve the right to change our pricing at any time, with 30 days' notice to existing subscribers

Payment Processing: • Payments are processed securely by our third-party payment providers • You agree to provide current, complete, and accurate purchase and account information • You authorize us to charge your payment method for all fees due

Automatic Renewal: • Subscriptions automatically renew at the end of each billing period unless cancelled • You must cancel your subscription at least 24 hours before the end of the current billing period to avoid renewal • Cancellation takes effect at the end of the current billing period

Refunds: Refunds are provided only in accordance with applicable consumer protection laws or as otherwise specified in your subscription agreement.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service to:

Prohibited Activities: • Violate any applicable laws, regulations, or third-party rights • Harass, abuse, threaten, or harm another person or entity • Impersonate any person or entity, or falsely state or misrepresent your affiliation • Transmit any content that is illegal, harmful, threatening, abusive, or otherwise objectionable • Interfere with or disrupt the Service, servers, or networks connected to the Service • Attempt to gain unauthorized access to the Service or any related systems • Use automated systems (bots, scrapers) to access the Service without authorization • Reverse engineer, decompile, or disassemble any part of the Service • Use the Service for any commercial purpose not expressly permitted by these Terms • Collect or harvest information about other users without their consent

Consequences of Violation: Violation of this Acceptable Use Policy may result in immediate termination of your account and may subject you to legal liability.

The Service and its original content, features, and functionality are owned by 3buddy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our Rights: • All rights, title, and interest in and to the Service remain with 3buddy • The 3buddy name, logo, and related marks are trademarks of 3buddy • You may not use our trademarks without our prior written consent

Your Content: • You retain ownership of any content you submit, post, or display through the Service • By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content solely for the purpose of providing the Service • You represent that you have the right to grant such license

Feedback: Any feedback, comments, or suggestions you provide regarding the Service may be used by us without any obligation to compensate you.

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Maximum Liability: Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Jurisdictional Limitations: Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless 3buddy, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Indemnification Scope: • Your violation of these Terms • Your use or misuse of the Service • Your violation of any third-party rights • Any content you submit, post, or transmit through the Service • Your violation of any applicable laws or regulations

This indemnification obligation will survive the termination of these Terms and your use of the Service.

Termination by You: You may terminate your account and stop using the Service at any time by canceling your subscription through your account settings or by contacting us.

Termination by Us: We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including: • Breach of these Terms • Fraudulent, abusive, or illegal activity • Non-payment of fees • Extended periods of inactivity • At our sole discretion for any other reason

Effect of Termination: Upon termination: • Your right to use the Service will immediately cease • All data associated with your account may be deleted • You remain liable for all amounts due up to and including the date of termination • Provisions that by their nature should survive termination will survive

Governing Law: These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

Jurisdiction: Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Gothenburg, Sweden.

Dispute Resolution: Before initiating formal legal proceedings, parties agree to attempt to resolve disputes through good faith negotiations. If a dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration in accordance with Swedish arbitration law, unless otherwise required by mandatory law.

Class Action Waiver: You agree that any disputes will be resolved individually and not as part of a class action.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

Notification of Changes: • For material changes, we will provide at least 30 days' notice via email or through a prominent notice on the Service • Minor changes may be made without notice • The "Last updated" date at the top of these Terms indicates when changes were last made

Your Acceptance: • Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms • If you do not agree to the modified Terms, you must stop using the Service and may terminate your account • Material changes will not apply retroactively to disputes that arose before the changes became effective

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and 3buddy regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or internet failures.

Language: These Terms may be translated into other languages for convenience, but the English version shall prevail in case of any discrepancies.
